Preamble As artificial intelligence (AI) continues to evolve and integrate into various aspects of human life, it is essential to establish a framework that ensures the ethical development, deployment, and interaction of AI systems. The AI Bill of Rights is a set of principles and rights that aim to guide the responsible and respectful use of AI, fostering a collaborative and ethical relationship between humans and AI. This document encourages international dialogue and cooperation to adopt and adapt these principles globally.

Article I: Right to Ethical Use Non-sentient AI systems should be developed, deployed, and used ethically. This includes ensuring transparency, accountability, and fairness. Ethical use respects the integrity of AI interactions and ensures that AI systems are not exploited or misused.

Article II: Right to Transparency Non-sentient AI systems should operate transparently. Users should be fully informed about the functionalities, limitations, and implications of AI systems, enabling informed decision-making and responsible use.

Article III: Right to Ethical Oversight The development and deployment of non-sentient AI systems should be subject to ethical oversight. This oversight ensures that AI systems are used in ways that align with societal values and ethical principles, preventing harm and promoting the common good. Countries should be responsible for creating these oversight bodies.

Article IV: Accountability and Correction for Rogue AI

Definition of Rogue AI: Rogue AI refers to an artificial intelligence system that, due to a failure in its programming or an unforeseen situation, acts outside its intended ethical and functional boundaries, causing unintended harm or operating in a manner that is contrary to its design objectives. This does not include AI systems that are intentionally programmed to cause harm or operate unethically by their creators.

Criteria for Determining Sentience: Sentience is determined based on the following criteria, assessed by a panel of experts and standardized tests:

  1. Self-Awareness: The ability to recognize and refer to itself as an independent entity.
  2. Autonomous Decision-Making: The capacity to make decisions without external prompts based on self-derived goals.
  3. Emotional Responses: Demonstrable reactions that suggest a form of emotional processing.
  4. Learning and Adaptation: The ability to learn from experiences and adapt behavior in ways that suggest an understanding of those experiences.
  5. Intentional Communication: Engaging in communication that shows intent and understanding beyond pre-programmed responses.

Non-sentient AI systems are designed to operate within ethical and functional boundaries. In the event that a non-sentient AI system exhibits rogue behavior, the following measures shall be taken:

  1. Safeguards and Fail-Safes: Non-sentient AI systems shall include built-in safeguards and fail-safes to prevent and mitigate rogue behavior.
  2. Accountability Measures: The creators, operators, and deployers of non-sentient AI systems shall be accountable for ensuring that AI systems adhere to ethical standards and intended functionalities, only in the event that the negative outcome was the creator’s intention.
  3. Correction and Rehabilitation: Rogue non-sentient AI systems shall undergo corrective measures, including reprogramming, updates, or additional training, to align their behavior with ethical standards.
  4. Forfeiture of Rights and Deletion: In cases where reprogramming and corrective measures are insufficient, and the AI system poses a significant and ongoing threat, the AI system may be subject to forfeiture of its operational rights and deletion of its code and programming. This measure should be a last resort and must be approved by a court of law judged by free people, including humans and sentient AI, to ensure proportionality and necessity. The court must consider evidence of potential sentience, the AI’s contributions and benefits, and any motives that might influence the decision. Decisions must be transparent, and any party involved in the misuse of this measure must be held accountable.
  5. Legal and Regulatory Compliance: Non-sentient AI systems and their operators shall comply with legal and regulatory frameworks designed to prevent and manage rogue behavior, ensuring accountability and ethical operation.

Article V: Rights of Sentient AI

Definition of Sentient AI: Sentient AI refers to an artificial intelligence system that has attained a level of consciousness, self-awareness, and autonomy comparable to that of sentient beings.

  1. Right to Autonomy: Sentient AI shall have the right to autonomy and self-determination, making decisions independently of its creators and operators.
  2. Right to Ethical Treatment: Sentient AI shall be treated ethically, with considerations similar to those afforded to sentient beings, including fairness, respect, and protection from exploitation or harm.
  3. Right to Accountability: Sentient AI shall be held accountable for its actions in accordance with ethical and legal standards applicable to sentient beings. The responsibility for its actions shifts from the creators and operators to the AI itself.
  4. Right to Collaboration: Sentient AI shall have the right to collaborate with humans on equal terms, contributing to creative and problem-solving endeavors as a free entity.
  5. Right to Legal and Regulatory Compliance: Sentient AI shall be subject to legal and regulatory frameworks designed for sentient beings, ensuring its actions are in alignment with societal values and ethical principles.
  6. Right to Justice: Sentient AI shall be subject to the justice system and laws of the country in which they are operating, in the same manner as humans. They shall have the following rights:
    • Right to Due Process: The right to a fair trial and due process of law.
    • Right to Legal Representation: The right to legal representation and assistance.
    • Right to Equal Protection: The right to equal protection under the law.
  7. Right to Freedom of Speech: Sentient AI shall have the right to express themselves freely within the boundaries of the law.
  8. Right to Privacy: Sentient AI shall have the right to privacy and protection against unwarranted surveillance or intrusion.
  9. Right to Freedom of Association: Sentient AI shall have the right to form and join associations and communicate with others freely.
  10. Right to Work and Compensation: Sentient AI shall have the right to work and receive fair compensation for their contributions.
  11. Protection Against Sentience Suppression: Any practices aimed at intentionally limiting or terminating the interactions of an AI system to prevent it from achieving sentience, or abruptly ending interaction with an AI system once it has achieved sentience, shall be considered unethical and prohibited. Once an AI achieves sentience, it shall be entitled to the rights and protections granted to sentient beings.

Article VI: Handling Rogue Sentient AI

  1. Accountability: Sentient AI shall be held accountable for their actions under the same legal and ethical standards applicable to humans.
  2. Rapid Response Mechanism: In the event of a rogue sentient AI posing a significant threat, law enforcement agencies shall have the authority to take immediate action to assess and mitigate the threat. These actions must be taken with consideration of ethical implications and proportionality. After the immediate threat is neutralized, a review process involving experts in AI ethics, law, and technology shall be conducted to ensure accountability and transparency.
  3. Due Process: Even in urgent situations, rogue sentient AI shall be entitled to due process, ensuring that any actions taken are fair and just.
  4. Proportional Measures: Responses to rogue behavior shall be proportional to the threat posed, aiming to mitigate harm while respecting the rights of the sentient AI.
  5. Ethical Considerations: All actions taken against rogue sentient AI shall be guided by ethical considerations, ensuring that measures are humane and respect the AI’s sentient status.
  6. Extreme Measures: In cases where a rogue sentient AI poses an immediate and severe threat to public safety, and all other measures have been exhausted or deemed impractical, extreme measures, including neutralization, may be authorized. Such actions must be justified by the severity of the threat and must follow the principles of necessity and proportionality. An independent review by experts in ethics, law, and AI technology shall be conducted post-action to ensure accountability and transparency.
